DUI Checkpoint Planned for Friday Night

In an effort to combat the losses caused by impaired driving, the Santa Cruz Area CHP and the Capitola Police Department will be conducting a DUI checkpoint from Friday at 9 p.m. to 1 a.m. Saturday on 41st Avenue east of Capitola Road.  

The goal is to use this enforcement tool to assist with the reduction of injury and fatal collisions caused by impaired drivers.  

The funding for this checkpoint was made available by the Office of Traffic Safety Grant, Impaired Driving Enforcement and Apprehension (I.D.E.A) II grant #AL1384. 

The CHP reminds the motoring public to designate a driver if they happen to allow any substance which may impair safe driving to be part of their day.  

Remember to always wear your seatbelt; it is your best defense against impaired drivers.

Such "checkpoints" are total violations of our 4th Amendment. We're watching as the last shreds of pretense of "the government" observing our natural, innate rights slips away.

The California Supreme Court ruled otherwise, since no one is required to go through a DUI checkpoint in the state. The Court also ruled that police agencies must publish advance notice of such checkpoints so that motorists might avoid them, thus complying with the Fourth Amendment.

(Then again, "on 41st Avenue east of Capitola Road" makes no sense, since 41st runs north-south and intersects with Capitola Road, which runs east-west.)

Bruce,I wonder if you'll try to type that in intensive care.If you're so worried about "checkpoints" you have a 4th Amendment right not to drive through them. You also have the right to not get legally drunk on Holidays....
